Según lo señalado, a los tres imputados le correspondía ejecutar las labores necesarias para la seguridad, mantención y cuidados de las redes de distribución, cables, torres, franjas de seguridad y postes de energía eléctrica, que -dijo Richards- fueron incumplidos por los imputados por una imprudente y negligente observancia de la regulación.
“La norma que se infringe está contenida en la ley de bosques (…) creemos que el uso de la distribución de energía eléctrica y la cantidad de normativa que lo regula fue vulnerada por la empresa CGE a través de sus ejecutivos y que a raíz de ello se generaron estos cuatro incendios que indicamos en la formalización y a fines de octubre en el tribunal de Licantén también vamos a formalizar por el mismo delito a los mismos ejecutivos, sumándose otros por el incendio que ocurrió en el sector de Aquelarre”, advirtió el fiscal.

“Si optamos por esa vía seguramente se exigirá a la compañía no sólo reparar a las víctimas sino que también el daño causado al medio ambiente y la flora y fauna”, afirmó.
Se estima que los daños causados hacienden a un monto cercano a los 2 mil millones de pesos y durante estos ocho meses fijados por el tribunal para la investigación se buscará la posibilidad de una suspensión bajo ciertas condiciones que irán en directo beneficio de los afectados.
Por lo pronto, los tres imputados quedaron bajo la medida cautelar de firma mensual y arraigo nacional en el caso de Ortega y Loyola, mientras que Sazo fue objeto de la cautelar de arraigo nacional.
